Foundry 76 Creative ("Foundry 76," "we," "us") provides website design, development, and related services as described in individual project proposals. The scope, timeline, and price for each project are set out in a written proposal or agreement. These general terms apply to all client engagements unless a specific agreement states otherwise.
A project begins when you accept our written proposal and pay the required deposit (typically 50% of the project fee). The proposal describes the work to be done, the deliverables, the timeline, the number of revision rounds, and the total price. By accepting the proposal and paying the deposit, you agree to these terms.
Unless otherwise stated in your proposal, payment is structured as follows: 50% deposit to begin work, and the remaining 50% due upon project completion and before the site goes live. Invoices are payable within 14 days. Late payments may delay project delivery. Maintenance plans are billed monthly in advance.
You agree to provide content (text, images, logos, and other materials) in a timely manner. You are responsible for ensuring that any content you provide does not infringe on third-party rights. You agree to provide feedback within the agreed revision rounds and timelines. Delays in providing content or feedback may extend the project timeline.
Each project includes a set number of revision rounds as stated in your proposal. A revision round is a collection of feedback provided at one time. Additional revision rounds beyond what is included in your proposal may incur additional charges. We'll always discuss and agree on any additional costs before proceeding.
Upon full payment, you own the final website design and content created specifically for your project. We retain ownership of any pre-existing tools, code libraries, or frameworks used in building your site. You grant us the right to display your completed website in our portfolio and marketing materials unless we agree otherwise in writing.
If we set up hosting or third-party services on your behalf, we will do so using reputable providers. You are responsible for ongoing subscription fees for any third-party services (hosting, domain registration, plugin licenses, etc.) unless those are included in a maintenance plan with us. We are not liable for service interruptions caused by third-party providers.
Foundry 76 provides website services on an "as-built" basis. We make no guarantees about specific business outcomes (such as increased traffic, sales, or search rankings) resulting from your new website. Our liability for any claim related to our services is limited to the amount you paid for the specific project in question.
Either party may cancel a project with written notice. If you cancel, you are responsible for payment for work completed up to the date of cancellation. If we cancel, we will refund any payment for work not yet completed. The deposit is non-refundable once work has begun.
We may update these terms from time to time. The terms in effect at the time you accept a proposal will govern that project. For ongoing services like maintenance plans, we will notify you of any material changes at least 30 days in advance.
